Rule 45
To be submitted before the Bench

(1) According to Clause (b) of Sub-rule (1) of Rule 32, if it is found that the manner in accordance with this paragraph has been met during the necessary examination of the application regarding the dispute of public right or interest, the application shall be registered by the concerned officer and submitted before the bench of a judge.
(2) After hearing the application submitted in accordance with sub-rule (1), the bench shall consider the following preliminary questions and order whether or not to issue a show cause order:-
(a) There is no real concern of the general public or any community on the subject matter of the petition,
(b) Whether the petitioner has a meaningful relationship and material interest in the matter of the petition,
(c) As mentioned by the petitioner, whether constitutional or legal question should be determined.
(3) Notwithstanding anything contained in clause (b) of sub-rule (1) of rule 32, the court shall be informed by any means that the general public has been seriously affected or is about to be seriously affected by any action taken or about to be taken in any matter involving public rights or concerns. If a letter, request, or report is received and if the Chief Justice orders that such letter, request, or report be accepted as a public dispute, the relevant officer shall register it and submit it to the bench of a judge.
